Website Use and General Liability

Addatextiles.com and all information, content, materials, and products included therein or otherwise made available through this Site are provided on an "as is" and "as available" basis unless otherwise specified. Adda Textiles makes no representation or warranties of any kind, express or implied, as to the operation or availability of this site or the information, content, materials, or products included therein or made available to you through this Site unless otherwise specified. You expressly agree that your use of this site is at your sole risk.

Adda Textiles is not liable for any damages of any kind arising from your use of this site, for any information, content, materials, or products included or or otherwise made available to you through this site, or for any products purchased through this site, including but not limited to direct, indirect, incidental, punitive and consequential damages, unless otherwise specified. 

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers exclusions, or limitations may not apply to you, and you may have additional rights.

Due to the nature of individual computers and monitors, actual fabric and product colors may vary slightly from what is seen on this Site. 

Adda Textiles reserves the right to revoke the account and access rights of any registered user of this Site who violates these Terms and Conditions, including misuse of intellectual property, unauthorized account use, or engagement in any improper or illegal conduct.

These Terms and Conditions are governed by the laws of the United States and of the State of New York. Adda Textiles reserves the right to modify these Terms and Conditions without prior notice. All purchase orders will be subject to Terms and Conditions in effect at the time an order is placed with Adda Textiles.

Warranty

Unless otherwise stated, all Adda Textiles fabrics are tested with ISO standards and meet or exceed quality and performance standards for commercial use. Adda Textiles fabrics will perform in accordance with generally accepted industry standards when used for their intended purpose, and are properly installed and maintained under normal, single-shift conditions for two (2) years from the date of invoice. Additional finishes applied to fabrics after purchase will void this warranty.

The Warranty is limited to a refund of the purchase price or replacement of the product with a mutually agreed upon product and does not cover: (1) use other than the intended purpose; (2) installation contrary to industry standard installation practices; (3) inappropriate maintenance or cleaning methods; (4) reverse crocking; (5) improper storage or handling; (6) any other damage or problem due to external causes unrelated to fabric defect.

Adda Textiles is not responsible for any labor costs.

This Warranty is non-transferable and non-assignable.

Orders

To order products, check stock or prices, request samples, or inquire about the status of your order, please email hello@addatextiles.com. All orders must be in writing or ordered through the website. All website orders are considered subject to approval.

Payment Terms

All orders require a 50% deposit, due at order placement, with the remainder of the balance (including any applicable taxes, freight, handling, etc.) due prior to shipment. Adda Textiles accepts ACH, wire transfer, check, American Express, MasterCard, and Visa.

Pricing

Prices are listed at net price in USD. Prices are subject to change, and Adda Textiles reserves the right to discontinue any pattern or color without prior notice. Pricing is FOB 27253. 

Taxes

All sales, use, excise, and other applicable taxes shall be paid by the Customer. If the Customer is exempt from paying any tax, Customer must submit the appropriate tax-exemption certificates.

Cancellations

Products are sold on a non-cancelable basis and cannot be accepted if the order has been cut and/or shipped.

Custom Orders

Custom orders are subject to minimum yardage requirements and up to 10% overage. Orders for custom products require a non-refundable 50% deposit, are non-cancelable, and custom yardage is non-returnable.

Force Majeure

Adda Textiles is not liable for delay or failure to perform due to force majeure, or any extraordinary event or circumstance beyond their control such as war, labor strike, pandemic, flood, fire, or due to any cause beyond reasonable control.

Claims

Customers should examine all products upon receipt to verify they are correct and as ordered. Customer is responsible for inspecting materials prior to installation. Claims for damaged materials that have been installed may not be honored. Claims relating to product defect or mis-shipped orders must be submitted in writing to Adda Textiles no later than 30 days from date of invoice. A Return Authorization is required prior to returning a claim. To request a Return Authorization, please contact hello@addatextiles.com and include your order information. If the claim is approved, Adda Textiles will issue a return shipping label at their cost. If the Return Authorization is issued, the returned product must be received by Adda Textiles within 30 days of Return Authorization issue date for credit to be processed. Adda Textiles will correct the order and re-ship at its cost or, in event of product unavailability, will issue a refund or credit.

Returns

Customers should examine all products upon receipt to verify they are correct and as ordered. Certain products are sold only on a non-returnable basis and require a signed acceptance of terms prior to order processing. Requests for returns other than claims will not be accepted after 30 days from invoice date, and no return will be accepted without a Return Authorization. If a Return Authorization is issued, yardage must be received by Adda Textiles within 30 days of issue date for credit to be processed. Returns of textiles will only be accepted for full bolts that are uncut and in salable condition.

All returns are subject to 35% restocking charge. Outbound and return freight charges will not be credited and are the responsibility of the Customer. No returns will e accepted for specially processed or discontinued products.
